My LLC return was filed and "accepted" on 3/32, but I received a letter from the IRS that it was not filed on time.

My TurboTax software states "accepted" on 3/23, but I received a letter from the IRS on 4/15 stating I was charges a penalty as my return was not filed on time.

Tax forms 1065 and 1120-S were due on March 15. Did you file one of those returns? If so, it would have been late after that date. There is no 3/32 date.

did you efile and receive acceptance on or before 3/15?  if not, and you mailed, did you get a postal receipt showing a date on or before 3/15

if this is your first time late filing, you can send back a letter with the notice requesting abatement of penalties.

explain why you filed late and that you have taken steps to ensure timely filing in the future.    the IRS will make a decision.


what if they deny the request - some additional interest because the payment will be later.  under no circumstances submit payment with request for abatement.  the IRS probably will take this as an admission that you owe and ignore the request for abatement.
