My children were claimed as dependents by their father, who is the noncustodial parent. He refused my request to amend his tax return.

Is there any way I can fix this problem without hiring an attorney?

You can file your return by mail.  The IRS will then contact each party for information about why you are eligible to claim your children.  The custodial parent is automatically assumed to be eligible to claim them unless you have signed away that right.
