If you are the custodial person you can get EIC and child care credit and file as head of household if otherwise qualified even if you allow the other parent to claim the dependency.

No, you do not need to amend. Your daughter will still appear on your return even though you are not claiming her as a dependent.   

 

The IRS rules for the Earned Income Tax Credit (EITC) differ from the rules for the Child Tax Credit and the Dependency Exemption. If you are the custodial parent (the child lived with you for more than half the year), you are the only one eligible to claim the EITC, even if you have agreed to let the other parent claim the child as a dependent for the Child Tax Credit.

 

When it's not your year to claim your daughter as a dependent here's what happens in TurboTax:

  • The child will not be listed as a dependent on the first page of your Form 1040.
  • The child will be listed on your Schedule EIC. Under IRS rules, the EITC benefit stays with the custodial parent. You can claim the EITC with a "qualifying child" even if you are not claiming that child as a dependent.
