If you have the legal right to claim your child and she gets claimed without your knowledge before you filed, you can still file your Tax Return, but you will need to mail it instead of e-file.

In order to challenge the false dependency claim and get yours approved, you will need to take the following steps:

  • Include the Dependent on your Tax Return and mail in your tax return.  
  • Once the IRS receives your return, they will send out paperwork to both you and the person who fraudulently claimed your Dependent to determine who should be claiming them.  
  • Once you prove you are the rightful claimer, they will issue your refund and rescind it from the fraudulent claimer.

This process takes time, but will be worth it in the end when you get the refund you are entitled to and the fraudster pays back the money they got plus interest and penalties.
