NON RESIDENT ALIEN  

If you are a non-resident alien, your return must be filed on Form 1040NR, which cannot be prepared using TurboTax.  You can use TT’s partner, sprintax:

According to this IRS source, if you meet the Substantial Presence Test , you may file as a US resident with a J1 visa.  In this case, you will need a W2 from an employer, have a valid Social Security Number, or other tax forms such as 1099 INT or Dividends if you received bank interest or dividends for the year. Here are the requirements listed that determine if you were substantially present during the tax year.

 

To meet this test, you must be physically present in the United States (U.S.) on at least:
 

  1. 31 days during the 2022 year, and
  2. 183 days during the 3-year period that includes the current year and the 2 years immediately before that, counting:
    • All the days you were present in the current year, and

 

  • 1/3 of the days you were present in the first year before the current year, and
  • 1/6 of the days you were present in the second year before the current year

If you did not meet these requirements, you will need to file a Non-Resident return.
