I received the 2014-7 notice through IHSS- California and it says I can amend my returns but will I have to pay the refund back that I received?

Wondering because is it mandatory to do so?

Yes, you should amend.  The way I read it, in order to have a correct and legal tax return, you need to amend for all payments after January 3rd, 2014.  You have the option to amend for years before that.

As for if you need to repay your refund, it depends on your circumstances.  If that was your only income, then the answer is probably yes, you would need to repay at least PART of the refund because that income does not qualify for the Earned Income Credit.

However, if you had other income, it is also possible that you will receive a BIGGER refund.  Without knowing all of your circumstances, it is impossible to tell you for sure.  You would need to amend to find out the result.
