If it has been longer than that and you are unable able to get things resolved with the IRS directly (1-800-829-1040), you can contact the Taxpayer Advocate. The Taxpayer Advocate is there to help you deal with the IRS when you are unable to get things straightened out on your own.

according to TAS rep I spoke to, they can do nothing until IRS gives you a determination. which you are still waiting for.
