I filled 1040 form instead of 1040NR. I can see on TurboTax that my federal and state E-file is Accepted. Checked state refund status,shows approved. What should I do?

If you have already filed, you will have to do an amendment.  To amend, please wait until your return is fully processed and you have received your refund or your payment has cleared.

You would need to submit both the Form 1040-X and form 1040NR together, here are the steps:

  • Download the Form 1040-X from IRS website (see below).  On the front page of Form 1040-X, enter your name, current address, and social security number (SSN) or IRS individual taxpayer identification number (ITIN)
  • Do not enter any other information on page 1.  
  • Do not complete Parts I or II on page 2 of Form 1040X.
  • Enter in Part III the reason why you are filing Form 1040X.
  • Complete a new or corrected form 1040-NR.  As TurboTax does not support nonresident forms, click here Sprintax.
  • Across the top of the 1040-NR, write “Amended”
  • Attach the new or corrected return (Form 1040NR) to the back of Form 1040-X and submit to the IRS.

Thanks for your quick response. Do you mean I need to wait for both state and federal refund to be processed? I couldn't get any update on my federal refund, website shows We cannot provide any information about your refund. Should I contact and confirm my status?

Yes, you should wait to receive refund from both federal and states.  As the phone line at IRS will be so busy when everyone tries to check on their refund status, if I were you, I would just wait.   Which website did you check ?  IRS's ?

Yes, I check IRS's check my refund status. I tried calling, the wait time was 1 hour. Couldn't talk to any representative. I used TurboTax to E-file. Federal tax was accepted on Jan 24th. Since then, I don't have any idea whats the status of my refund.

Right now, the approximately time is at 21 days.  I would give some time. it's close.

Hi, I have a followup question. If after amending, it finds I owe federal tax, i.e. I was over-compensated in the last time. How does IRS charge me? Thank you!

what do you mean with: Across the top of the 1040-NR, write “Amended? in addition do you know where to send the 1040X and 1040NR?

@denise1989 If you look on page 18 of theInstructions for 1040X form, it'll advise you where to mail in your amended return.

@wrm5001 The IRS will not start processing federal returns until February 12, 2021. Once the IRS accepts your return, most refunds are received within 21 days although some do require more time to review. Please see the TurboTax FAQ: When will I get my IRS tax refund? for more information.
