Who supported you?  If you had no taxable earned income, then there is no refund available to you.  Without income from working, you are not eligible for the child tax credit (which lowers your taxable income) or the earned income credit.  The person who supported you may be able to claim you and your child as dependents, though.

You said your husband "paid everything," but you also said your BIL also supported you. It can't be both. Your BIL cannot claim you or your child.  Do as I indicated in the answer below.

You can file a Joint return with your husband, but he must get an ITIN:
