I did not receive my refund of 3,211. IRS kept refund. No notice. I took out audit insurance to make sure I filed properly. IRS said that it was for taxes owed for 2024.

Is this legal? Why wasn't I notified? I had several others say this same thing happened to them. I live off SSI

Yes, the IRS is legally authorized to do this, but the lack of notice and the timing involve specific rules you should know about.

 

Legally, the government is required to send you a notice before or at the time of the offset. However, there are two common reasons why you might not have seen it:

 

  1. The "Notice of Intent": The IRS usually sends several letters (like CP14 or CP501) months before your refund is filed, stating you owe money. They consider these the "warning."
  2. The Post-Offset Letter: Once they actually take the money, the Bureau of the Fiscal Service (BFS)—not the IRS—is supposed to mail you a notice explaining how much was taken and who received it.
  3. Mail Delays: If you have moved or if the mail is delayed, you might not receive the letter until after you realize the money is gone.

3. What About Your Audit Insurance?

Audit insurance (often sold by tax software companies) generally covers professional representation if the IRS questions the accuracy of your return.

 

  1. The Catch: Audit insurance usually does not pay the tax debt itself.
  2. Why it didn't help here: If the IRS kept your 2025 refund to pay a 2024 debt, they aren't saying your current filing is wrong; they are simply collecting a debt from a previous year. Your insurance provider likely won't cover a debt you actually owe from a prior year.

4. How to Get Help (Economic Hardship)

Because you live on SSI, you may qualify for an Offset Bypass Refund (OBR). This is a special process where the IRS "bypasses" the debt collection to give you the refund because you are facing an extreme financial crisis (like being unable to pay rent or utilities).

 

Timing is critical. Once the IRS has fully "applied" the money to the old debt, it is very difficult to get back. You need to act immediately.

 

Immediate Next Steps:

  1. Call the Treasury Offset Program (TOP): Contact the BFS at 800-304-3107 to confirm exactly what debt the money was taken for.
  2. Contact the Taxpayer Advocate Service (TAS): Since you are on SSI and this is a hardship, call 877-777-4778. They are an independent organization within the IRS specifically designed to help people who are being harmed by the system.
  3. Check your 2024 Account: Log into your IRS Online Account to see why they think you owed money for 2024. If it was an error, you can file an amended return to get that money back.

If this refund was meant for basic survival, please contact the Taxpayer Advocate today and mention your "Economic Hardship" and "SSI status" immediately.

The IRS can seize your refund if you owed back taxes or child support or certain other debts.   Yes it is legal.   TurboTax gets no information about offsets to your refund.    The IRS will mail you a letter--usually a few weeks later---when they seize your refund to explain the reason(s).

TurboTax does not receive feedback from the IRS regarding money that was offset from your refund.  If you owed back taxes or child support, you will receive a letter of explanation from the IRS in several weeks.  The WMR site will contain a message regarding your offset.  It is also possible that the IRS caught a mistake you made and reduced your refund.
