Forgot to claim tax treaty

Hi!

I am a citizen of China and I am currently working under an F1 visa using my OPT. After I submitted my tax return through Turbotax I realized that I should be eligible for tax treaty. Now should I wait for my federal return to be accepted and then submit a 1040-X form and form 8833 to claim my tax treaty?

Forgot to claim tax treaty

Yes, you should wait for your federal return to be accepted before submitting a 1040-X form and Form 8833 to claim your tax treaty benefits. Here's a quick guide:

  1. Wait for Acceptance: Ensure your federal return is accepted by the IRS.
  2. File Form 1040-X: Use this form to amend your return.
  3. Include Form 8833: turboTax will help you complete this form is used to disclose your tax treaty position.

To log in and amend your return in TurboTax, follow these steps:

  1. Log In: Go to the TurboTax login page
  2. and enter your credentials.
  3. Select the Year: On the Tax Home screen, scroll down to "Your tax returns & documents" and select the year you want to amend. (If this is a 2024 return just open your return and click the link that says amend)
  4. Amend Return: Select the "Amend (change) return" dropdown, then "Amend using TurboTax Online"
  5. Make Changes: Continue through the screens, make the necessary changes, and carefully answer the remaining questions to finish amending your return.
