Can I claim my NYS taxes paid to the irs last year on this years federal returns

I paid NYS taxes on my returns last year. Can I claim is as a deduction this years Federal returns?

Yes if you Itemized Deductions.  

You can deduct any state taxes paid (for any year) or state estimates actually paid in during the year on your federal return if you Itemize deductions.  But just the tax, not any interest or penalties.   If you transferred from last year it might already be filled in.

 

But if you itemize there is a limit on deducting tax paid.  There is a max 10,000 limit (5,000 MFS) of property tax and state taxes "SALT".  SALT is State And Local Tax.  Which includes property tax, any state tax paid like for last year’s return and includes any state withholding from your W2s and any 1099s you have. And any taxes in W2 box 14 and 19 like SDI or VDI. You can only deduct up to 10,000 (5,000 MFS) for SALT State and Local Taxes.

State and local taxes paid are:

any state withholding from your paychecks, retirement checks, unemployment checks, etc.

a state tax due you paid last year

any state estimated tax payments you made

any local taxes withheld on your checks like SDI in box 14 or 19 on your W2 - those will transfer automatically from your W2.

I hope you didn't pay your New York tax to the IRS. The IRS handles only federal tax. You have to pay your New York tax to the New York State Department of Taxation and Finance.


On your 2022 federal tax return you can claim an itemized deduction for any New York tax that you paid IN 2022 (provided that you actually paid it to New York). It doesn't matter what year the state tax payments were FOR.


But the deduction might not make any difference in your federal tax. Besides the $10,000 (or $5,000) limit on total state and local taxes that VolvoGirl discussed, it's an itemized deduction. That means that it won't make any difference in your federal tax unless your total itemized deductions are more than your standard deduction.
