Internation Student (non-resident alien). Filed 2016 tax returns and 1098T through TurboTax. Got $1000 as American Opportunity Credit. Need to amend it and return $1000.

Hello, I am an International Student (non-resident alien), and I came to the US in 2016. I filed my 2016 tax returns through TurboTax and also filed for 1098T which I was not supposed to. Now I have got $1000 as American Opportunity credit. This was a mistake from my side. I want to amend my return and give back the $1000. I have also filed my W2 returns through TurboTax which I guess shouldn't be done because, as told by my university later we are not supposed to e-file our tax. Kindly suggest as to how I can proceed with this and what forms do I have to fill and how to get around with the amendment.

Hello! 

As you have already filed your taxes with TurboTax, you will just need to amend your Form 1040 to a Form 1040-NR. I would suggest you do the amendment by following the instructions below and pay back the difference in refund between the Form 1040 and 1040-NR if it's not the $1000. 

 

You just need to amend your Form 1040 to Form 1040NR.  No worries, you did not perform any illegal act. 

 

Here are the steps:

You would need to submit both the Form 1040-X and Form 1040NR together:

  1. Download the Form 1040-X from the IRS website (see below).  On the front page of Form 1040-X, enter your name, current address, and social security number (SSN) or IRS individual taxpayer identification number (ITIN)
  2. Do not enter any other information on page 1.  
  3. Do not complete Parts I or II on page 2 of Form 1040X.
  4. Enter in Part III the reason why you are filing Form 1040X.
  5. Complete a new or corrected Form 1040-NR.  As TurboTax does not support nonresident forms, click here Sprintax.
  6. Across the top of Form 1040-NR, write “Amended”
  7. Attach the new or corrected return (Form 1040NR) to the back of Form 1040-X.
