Question

I got a letter from IRS requesting W2's to show my excess SS tax, and a letter from IL state which changed my Illinois base income. how do I respond to these.

I claimed excess SS withholding, which was due to multiple W2's from different employers and the total withhold exceeded the cap. For IL, I claimed non-residency as I worked the whole year in a different state, but one of my W2's had IL tax withholding, probably because that employer had my (old) IL mailing address in file.

For the excess SS, were all the W2s for you?  Are you married?  The $7,960.80 max is per person not both spouses combined.  And only from W2 box 4.

Thanks for the answers. I’m married filing jointly. My wife was not working so she didn’t have a W2, all of the SS withholding were from my W2s.  TurboTax had all these info and still suggested there was an excess withholding. So I think the max of  $7860 should be applicable to this situation. But maybe I was wrong?

Yes if you had more than the max SS you get it back on schedule 5 line 72.  The IRS probably didn't get a copy of one of your W2s from the employer to match up.  Should be ok.

send the copies of the w-2's to the IRS otherwise the IRS will do nothing.  IL is a different matter.

from illinois instructions 

You are an Illinois resident if you were domiciled in Illinois for the entire tax year. Your domicile is the place where

you reside and the place where you intend to return after temporary absences. Temporary absences may include

duty in the U.S. Armed Forces, residence in a foreign country, out-of-state residence as a student, or out-of-state

residence during the winter or summer.


did you file a non-resident return to get your Il withholding back?  even if yes, it may be best to contact the dept of revenue to see what you need to provide them to prove you were a full year non-resident.
